Terms of Service

Draft — pending legal review. These pages are a working template adapted from UK ICO guidance and Stripe's requirements, intended as a starting point only. They have not been reviewed by a solicitor and must not be relied upon for compliance.

These Terms govern your use of PartyGraph.co.uk and the PartyGraph platform (collectively, the "Service"). By creating an account, you agree to these Terms.

1. Accounts and workspaces

You may create a workspace (the "Workspace") on PartyGraph and become its owner. As owner you are responsible for the actions of anyone you invite into your Workspace and for the content you publish through it.

2. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose;
  • Upload content that infringes another party's rights;
  • Attempt to access another customer's data;
  • Reverse-engineer the Service or use it to build a competing product;
  • Send spam, malware or attempt to disrupt the Service.

3. Fees and billing

Plan fees are listed on our pricing page and are exclusive of VAT unless stated. Payments are handled by Stripe. Subscriptions auto-renew until cancelled. Per-event fees are charged at the time of event creation and are non-refundable once an event has gone live.

4. One event per purchase — anti-reuse rules

Each per-event purchase covers exactly one event. To keep that fair for everyone, the Event details (name, welcome message, time zone, date and time) become read-only once the event has clearly been used. The thresholds are:

  • Date locked: calendar-date moves are blocked when the event is within 24 hours of its scheduled start and more than 25 photos have been uploaded via the guest QR (counted across the lifetime of the event — deleting photos does not reset the counter). Time-of-day edits remain available.
  • Full lock: the entire Event details form becomes read-only when the event is inside its 7-day live window and more than 50 photos have been uploaded via the guest QR (also counted across the lifetime of the event). Branding and uploads moderation remain editable; date/time/name/welcome are frozen.

These limits exist to prevent a paid event from being silently repurposed for a future date. If you have a genuine reason to change the date inside a locked window — for example, a venue cancellation, weather event, or a technical issue on our side — please contact us and we’ll review case-by-case.

5. Refunds

Self-service refunds are available when fewer than 10 guest uploads have been approved and there are more than 24 hours until the event start. The Request a refund form remains accessible at all times, including when the anti-reuse locks above are in effect. If the automated eligibility check rejects your request because of a technical fault with our product, our outage, or another reason that is not your responsibility, contact our team via the form on the event page or at /contact and we will process the refund manually through Stripe.

6. Your content, your responsibility

You retain ownership of all content you upload. You grant PartyGraph a limited licence to host, display and process that content for the purpose of providing the Service to you and your guests. You confirm that you have the right to share any content you upload and that it does not violate the rights of any third party.

7. Guest data and lawful basis

When you run an event, you are the controller of guest personal data and PartyGraph is your processor. You must have a lawful basis under UK GDPR for processing that data, must provide your guests with an appropriate privacy notice, and must respond to their data-rights requests where the law requires.

8. Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced where reasonably practical. We are not liable for outages caused by third parties (e.g. cloud providers, payment processors).

9. Termination

You may cancel at any time from your billing settings. We may terminate or suspend accounts that breach these Terms. On termination, your data will be retained for 12 months and then deleted, unless you request earlier deletion.

10. Liability

To the maximum extent permitted by law, PartyGraph's aggregate liability under these Terms is capped at the fees you have paid in the twelve months preceding the claim. We are not liable for indirect or consequential losses.

11. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute.
